Lesbian disclosure allegations denied

A request by a San Carlos woman to the state attorney general to file charges against the San Mateo County district attorney for disclosing to her ex-husband that that she is a lesbian has been denied.

Tom Casey, counsel for San Mateo County, said yesterday that Attorney General Bill Lockyer's office found that the allegations made by Ramona Gatto against District Attorney Jim Fox and Assistant District Attorney Morley Pitt were without basis.

Gatto accused Fox and Pitt of illegally and unethically revealing to her ex-husband, Timothy Gatto, a county probation officer, that she is a lesbian, sparking a custody battle for their daughter Marina, now a 14-year-old. Ramona Gatto won the case to keep her daughter, but she wants to recoup her court costs.

According to a letter from the attorney general's office to Gatto, dated Nov. 8 but not released until yesterday by San Mateo County, rejecting the request for charges to be filed,
